TO THE BOARD OF REGENTS OF THE AMERICAN COLLEGE OF COMMERCIAL FINANCE LAWYERS:

Your executive committee (consisting of the current officers and past president) held its organizational meeting for this year this past week and I am pleased to report to you the following:

1. First, we want to thank once again Tom Welsh for the outstanding program that he was instrumental in putting together at the Dallas meeting as a start of the continuing ADR colloquy. I have asked Tom to continue his wonderful representation of the College with that group and to report to us any ideas, suggestions, etc. for future use of the College’s resources.

2. Plans for the Don Rapson memorial dinner to be held in New York City the night of Thursday, August 7, 2007 are in their final stages. We all owe a debt of gratitute to Tom Snow, Ed Smith and Maury Poscover for spearheading that effort on the College’s behalf. Ed Smith is planning the program and we encourage those of you who have not signed up to do so as soon as you can (I sent out an email blast on that yesterday with details about cost and where to send your reservation form and check) so the actual count can be finalized. The College, together with ACFAand CIT, are sponsors of the evening and it should be a meaningful tribute to one of the giants of the commercial finance field.

3. With the concurrence of the executive committee, I have decided to establish earlier, rather than later, the regents nominating committee, the fellows nominating committee, the officers nominating committee, the Grant Gilmore Award Committee, and the Homer Kripke Achievement/Deserving Special Service Award so those committees can get organized and, most importantly, up and running for the coming year. Over the course of the next several weeks, I will be in touch with you about chairs and members for those committees.

4. One of our goals of the executive committee for this year will be enhanced involvement in the activities of the College by all of our Regents and Fellows. Toward that end, we have identified the need to enhance our communications and that involves a revaluation and perhaps upgrade of our website. Steve Leitess is to be congratulated by all of us for all that he has done – and continues to do – to get the website up and running and supervising its maintenance. You will hopefully hear more about that in the future and if any of you have an interest in participating in that worthy project, please let me know as we need all of the high tech gurus that we can find.

5. We have scheduled telephone meetings for the Board of Regents at 3 pm, eastern time, on Wednesday, November 6, 2008 (our regular mid-year meeting) and on Thursday, March 19, 2009 (for the election of new Fellows well before next April’s Vancouver meeting). Please mark your calendars and as the dates get closer, I will distribute the dial in information.

6. Mark your calendars now for next year’s spring ABA Business Law Section Meeting in Vancouver, Canada. Our annual Fellows dinner will be held in conjunction with that meeting on the night of Saturday, April 19, 2009. Our resident Fellow in that city, Daryl Clark, has gratiously agreed to chair the dinner committee and I am certain that it will match – if not exceed – the outstanding dinner just organized by Linda Sartin in Dallas.

I thank you again for the privilege of being your president for the coming year. I encourage each of you to let me (or any other officer of the College) know if you recognize any opportunities for a College sponsorship or a College activity.
